- Estate Planning in Real Estate in a Trump Era: Robin Klomparens, Esq. Director at Fennermore.WKBKY and Kristin Capritto, Esq. Partner at Downey Brand will present significant topics and strategies relevant to estate and tax planning for real estate-based clients, including farmers and ranchers. Whether your clients are small or large, the authors will cover various techniques used in this environment to assist your clients with real estate transfers, both pre- and post-death, and their estate planning concerns. Both are highly recognized practitioners, advising clients with real estate and other assets in the estate planning arena.
- Understand how to reduce estate taxes on real estate assets including the property tax consequences;
- Learn best planning options (including charitable) in a higher interest rate environment; and
- Appreciate the use of post death estate elections for real estate holdings; taxable or not.
- Trends in 1031 Exchanges: Jeff Yonamine, VP of Exchange Resources, Inc. and Erin Riley, VP and Counsel, of Asset Preservation, Inc. to cover the latest developments in Section 1031 exchanges. Market trends, and high real estate prices have increased the use of parking transactions, build-to-suit swaps, and buyer-carryback notes into exchanges. In addition, the impact of California FTB wins and losses, have had a significant impact on whether/when drop-and-swaps work or are risky or whether alternatives should be considered.
- Learn how and when reverse exchanges are used;
- Understand the separate impacts of seller financing on the relinquished and replacement stages of exchanges;
- Develop working knowledge on build-to-suit exchanges, where they work and how to implement; and
- Appreciate alternatives to drop-and-swap transactions should still be considered.
- Real Estate Insights before the Franchise Tax Board: This program provides insights from the Legal Division of the Franchise Tax Board in connection with real estate matters. Mira Coutinho, Attorney IV, and Christopher Davis, Attorney, in the Legal Division of the FTB will cover insights on the issues and positions of the FTB, covering recent controversies, the issues to be addressed in pending Section 1031 California regulations to be released, and other matters for discussion. This program includes an introduction by Jenna Lewis, Assistant Chief Counsel in the FTB.
- Understand recent OTA Cases, Regulations affecting Real Estate.
- Learn why certain easements partly/fully fail as conservation easements.
- Appreciate why the FTB is considering 1031 Regulations.
- Assessor’s Office, Property Tax Developments: Christina Wynn, Sacramento County Assessor and Staff will cover insights as to the Assessor’s Office, and a selection of property tax matters of interest, including guidance under their death of a property owner webpage, probate concerns related to Prop 19, and a Prop 19 multi-generational example. Whether it is addressing Prop 19, understanding the assessment process, or how exclusions work, Ms. Winn has provided resources to assist CPAs in advising their clients as to real estate property tax concerns.
